STANDARD TERMS AND CONDITIONS OF SALE

1. GENERAL PROVISIONS

1.1. These Terms and Conditions of Sale (hereinafter – the "Terms") govern the mutual rights, obligations, and liability of the person purchasing products in the online store at www.wideez.lt and www.wideez.com (hereinafter – the "Buyer") and Aistė Dargevičiūtė, operating under individual-activity certificate No. 1515936 (hereinafter – the "Seller").

1.3. By placing an order in the online store, the Buyer confirms that they have read and agree to these Terms.

1.4. The Seller has the right to amend or supplement the Terms at any time. The version of the Terms in force at the time the order is placed shall apply to the Buyer.

2. CONCLUSION OF THE SALES CONTRACT

2.1. A contract between the Buyer and the Seller is deemed concluded from the moment the Buyer selects products, adds them to the shopping cart, provides a delivery address, chooses a payment method, confirms having read the Terms, clicks the "Order" (or "Pay") button, and completes payment.

2.2. Every contract concluded between the Buyer and the Seller is stored in the Seller's database.

3. PRODUCT PRICES AND PAYMENT

3.1. Product prices in the online store are stated in euros (EUR) and include all legally applicable taxes. Delivery charges are not included in the product price and are shown separately before the order is confirmed.

3.2. The Buyer may pay for products:

●        by online banking through licensed payment processing operators;

●        by bank card;

●        by any other method indicated in the online store.

3.3. The Seller undertakes to process the order only after receiving full payment for the product and delivery price (except where cash on delivery has been selected, if such a service is offered).

4. DELIVERY OF PRODUCTS

4.1. Products are delivered by the method chosen by the Buyer (e.g., to parcel lockers or via a courier service) throughout the territory of the Republic of Lithuania (and other specified countries).

4.2. Delivery times and costs are indicated when the order is placed. The standard delivery time within Lithuania is 1–3 business days from the moment of payment, unless stated otherwise in the product description.

4.3. The Buyer must inspect the condition of the received parcel (whether the packaging is undamaged). If damage to the packaging or a discrepancy in the products is noticed, the Buyer must record this in the courier's documentation or notify the Seller no later than within 24 hours of receipt.

4.4. The Seller is released from liability for a breach of delivery deadlines if products are not delivered to the Buyer, or are delivered late, due to the Buyer's fault or due to circumstances attributable to third parties (courier services).

5. RETURNS AND EXCHANGES (14-DAY RIGHT OF WITHDRAWAL)

5.1. The Buyer (as a consumer) has the right to withdraw from a sales contract concluded in the online store by notifying the Seller within 14 (fourteen) days of receiving the products, without giving any reason.

5.2. To return products, the Buyer must complete the withdrawal (return) form provided by the Seller or submit a clear statement by email to [email protected].

5.3. Requirements for returned footwear and other products:

●        returned footwear must be unworn outdoors, unused, undamaged, and not have lost its commercial appearance (trying items on indoors, without damaging the soles or materials, is not considered a loss of appearance);

●        the product must be returned in its original, undamaged packaging (shoe box) with all attached tags and accessories;

●        the product must be returned in the same configuration in which it was received.

5.4. The cost of returning products is borne by the Buyer, except when a defective or incorrect product is being returned.

5.5. The Seller undertakes to refund the Buyer all amounts paid (including the cost of the cheapest standard delivery option) no later than 14 days from the date the Seller received the Buyer's notice of withdrawal, provided that the Seller may withhold the refund until the returned products are received, or until the Buyer provides proof that the products have been shipped.

5.6. The Buyer has the right to exchange footwear of the wrong size or model for another size/model, provided the Seller has the required stock available.

6. PRODUCT QUALITY AND WARRANTY

6.1. All products sold in the online store are covered by the statutory 2 (two) year legal warranty for quality defects.

6.2. The warranty does not apply where footwear defects have arisen due to:

●        normal wear and tear during use;

●        improper care of the footwear, or use not in accordance with its intended purpose (e.g., using casual shoes for sports if they are not designed for that purpose);

●        mechanical damage caused by the Buyer or third parties;

●        washing the footwear in a washing machine (unless otherwise indicated by the manufacturer).

6.3. Upon noticing a quality defect, the Buyer must contact the Seller by email, providing proof of purchase (VAT invoice, receipt, or bank statement) along with photographs/description of the defect.

7. PROCESSING OF PERSONAL DATA

7.1. The Seller processes the Buyer's personal data in accordance with the General Data Protection Regulation (GDPR) and the Seller's Privacy Policy.

7.2. The Privacy Policy is available on a separate page of the online store and forms an integral part of these Terms.

8. LIMITATION OF LIABILITY (FORCE MAJEURE)

8.1. The Seller shall not be liable for any failure or improper performance of its obligations if this results from force majeure circumstances beyond the Seller's reasonable control and which could not have been reasonably foreseen at the time the contract was concluded, and the Seller shall inform the Buyer of such circumstances as soon as reasonably possible.

9. FINAL PROVISIONS AND DISPUTE RESOLUTION

9.1. These Terms and the relationship between the Buyer and the Seller are governed by the laws of the Republic of Lithuania.

9.2. Any disagreements arising from the performance of these Terms shall be resolved through negotiation. If no agreement is reached, the Buyer (as a consumer) has the right to contact the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, Lithuania, email: [email protected], website: www.vvtat.lt), or to submit a complaint via the EU Online Dispute Resolution (ODR) platform at http://ec.europa.eu/odr/.
